Account EA An EA Account is required to access and use many EA services, including online games. You also acknowledge that you are not a person with whom EA is prohibited from doing business under these export control laws. 14. Changes to this Agreement EA reserves the right to change this Agreement from time to time, so please review it frequently. For EA players who have accepted a version of the Agreement prior to the changes, the revisions will take effect 30 days after posting on terms.ea.com. Your continued use of the EA Services signifies your acceptance of the changes. Once you have accepted a version of the Agreement, we will not make any future material changes without your express consent. If you are asked to accept material changes to this Agreement and refuse to do so, you may not be able to continue using the EA service. 15. Dispute Resolution by Binding Arbitration THIS ARTICLE APPLIES TO ALL CONSUMERS AND ENTITIES WHO HAVE ACCEPTED THE TERMS OF THIS AGREEMENT. EXCLUDES RESIDENTS IN QUEBEC, RUSSIA, SWITZERLAND, BRAZIL, MEXICO, EEA MEMBER STATES AND THE REPUBLIC OF KOREA. BY ACCEPTING THE TERMS OF THIS AGREEMENT, YOU AND EA EXPRESSLY DISCLAIM THE RIGHT TO SEEK A JURY PROCESS AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. This article offers a simplified way for resolving any disputes between the parties. Most user issues can be resolved quickly and comprehensively by logging into EA's customer support interface through their account at help.ea.com. If EA is unable to resolve your issue, you and EA agree to be bound by the procedure set forth in this article for resolving any dispute. This is an agreement between you and EA and applies to their respective agents, employees, subsidiaries, predecessors, successors, beneficiaries and assignees. This arbitration agreement pertains to an interstate commercial transaction, so the interpretation and application of this section is governed by the Federal Arbitration Act. This article must be interpreted broadly and remains valid even after the termination of this Agreement. Claims Handled by Arbitration. All disputes, claims or disputes arising out of or relating to this Agreement, any EA service and its marketing, or your relationship with EA ("Disputes") are resolved solely by binding arbitration. This includes claims accrued prior to your entering into this Agreement. The only Disputes not covered by this article are claims (i) regarding the infringement, protection or validity of trade secrets, copyrights, trademark or patent rights owned by you, EA or EA's licensors; (ii) to enforce, if you reside in Australia, a right under Australian consumer law; and (iii) brought before a court dedicated to the resolution of minor disputes. Informal negotiations You and EA must attempt to resolve any Dispute informally for at least 30 days prior to commencing arbitration. Informal negotiations will commence upon receipt of a written notification sent by one party to the other ("Notice of Dispute"). The Notice of Dispute must: (a) include the full name and contact details of the injured party; (b) describe the nature and basis of the claim or dispute; and (c) specify the specific means of remediation required. EA will send its Notice of Dispute to your billing address or email address. You must send your Notice of Dispute to: Electronic Arts Inc., 209 Redwood Shores Parkway, Redwood City CA 94065, ATTENTION: Legal Department. Binding Arbitration If you and EA are unable to settle a Dispute informally, they may decide to resolve it definitively and exclusively through binding arbitration. One party's arbitration is final and binding on the other. The arbitration will be handled by the American Arbitration Association ("AAA") under the relevant Commercial Arbitration Rules and, where applicable, the AAA's Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules" Procedure for consumer disputes), both available on the website www.adr.org. Your arbitration fees and arbitrator's compensation share are governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. If the arbitrator believes that such costs are excessive or if you send EA, at the address of the Notice of Dispute, a notice stating that you are unable to pay the fees necessary to initiate arbitration, EA will pay all costs associated with the arbitration. The arbitration may be conducted in person, by submitting documents, by telephone or online. The arbitrator will make his decision in writing and provide a statement containing the reasons for the verdict, if requested by either party. The arbitrator must abide by the laws in force, otherwise any verdict may be challenged. You and EA may take action to demand arbitration, suspend pending proceedings, or confirm, modify, invalidate, or try the arbitrator's verdict. Limits YOU AND EA AGREE THAT BOTH MAY MAKE CLAIMS AGAINST THE OTHER ONLY TO THE LIMIT OF YOUR INDIVIDUAL CAPACITY AND NOT AS CIVIL PARTIES OR MEMBER OF A CLASS IN A CLASS ACTION OR IN ANY REPRESENTATIVE PROCEDURE. The arbitrator may not combine the claims of another individual with those of the user and may not preside over representative or class proceedings of any kind. The arbitrator may make a declaratory or injunction only in favor of the individual party requesting compensation and only to the extent necessary to satisfy the request of that individual party. If this specific subsection proves unenforceable, the entire arbitration agreement shall be deemed null and void. Place If you are a resident of the United States, the arbitration will be held in a place that is reasonably reachable by you. For non-US residents, arbitration must be initiated in San Mateo County, State of California, United States of America; you and EA agree to submit to the exercise of the personal jurisdiction of such court for the purposes of executing the arbitration, suspending pending proceedings, or confirming, modifying, annulling or judging the arbitrator's compensation. Compensation If the arbitrator's ruling is in favor of the user's claims against EA and establishes a higher compensation, in monetary value, than that proposed in the last trading offer signed by EA before sending its final written requests to the referee, EA must: pay you 150% of the arbitrator's compensation, up to $ 5,000 in addition to the compensation itself; as well as reimburse the arbitration fees paid by you to the AAA. Changes to this Arbitration Agreement EA will not apply material changes to this arbitration agreement unless expressly accepted by you. 16. Additional Terms for PlayStation® For PlayStation ™ Store purchases in Europe All content purchased from an in-game store will be purchased from Sony Interactive Entertainment Network Europe Limited (“SIENE”) and will be subject to the PlayStation ™ Network Terms of Service and Terms of Use available on the PlayStation ™ Store.
